Who is an Attorney?

An attorney is a lawyer, who has successfully passed the bar exam and complies with legal requirements to practice the profession of a lawyer while being a member of the Bar Association of Slovenia. Attorneyship is a liberal profession with a pivotal role as a part of the judicial system. An attorney advises the client on personal and business legal issues, in concluding and terminating legal transactions as well as representing the client in matters before public authorities, local self-government and other authorities and organisations.

Why do I Need an Attorney?

Hiring an attorney saves money and time. An attorney can settle a dispute before it has fully developed. They navigate through the complicated and demanding layers of the law with its regulations and case law constantly changing, being fully aware that the smallest error may lead to a justice lost or cause irreparable damage. An attorney will approach your case more objectively and rationally as they are fully concentrated on the relevant legal content at hand without being personally and emotionally involved.

People often make the mistake of seeking legal assistance at the last moment and many times it is too late. Due to strenuous relationships and rooted misunderstandings between clients, little room is left for a mutual solution, leaving the attorneys with a difficult task of finding a quick and financially favourable solution. In such cases, law suits and appeals are often filed. The latter only prolongs the procedures and enhances the costs.

This is why seeking an attorney, before you find yourself in a legal rut and before the dispute has taken full course, is essential. We are here to help you create successful and all-round favourable business and personal relationships, because we believe the right approach in the beginning significantly decreases the possibility of a dispute later on. (e.g. a clear and concise Business Cooperation Contract or a suitable and just property ownership arrangement before death).

If it nevertheless does come to a complication, seek legal assistance early on before it develops into a dispute – for example, when you decide to terminate a relationship (termination of employment contract, divorce etc.), or when you determine for the first time that your rights have been violated (a part of your estate is claimed by someone else, your tenant is not paying their rent or they are not acknowledging your investments into the property etc.). If legal assistance is provided at the right time, the chances for an amicable solution are usually the best. With the right reaction, countless hours in court can be avoided despite a dispute. A timely engagement of an attorney for your personal or business affairs is considerably cheaper than having an attorney represent you in lengthy court proceedings, not to mention the nerves you will be spared without jeopardizing (or ruining) your personal and business relationships.

When you do find yourself in court proceedings, hiring an attorney is almost always necessary. Court proceedings are usually accompanied with (complicated) rules which may cause a client who is not well-skilled in this area to lose certain rights regardless of their claim being completely justified. Rather than uncovering the truth, the aim of the mentioned rules in court procedures is to ensure a speedy, simple and economical discharge of the procedure.

When you choose an attorney to represent you in court proceedings, you will have more freedom to concentrate on the content of the procedure while your attorney will take care of your rights. Court proceedings do offer solution of a dispute by settlement and this is a solution an attorney will strive for if it is in best interest of the client and something they want.

It was the ancient Romans who first used the phrase »Ignorantia iuris nocet« (Not knowing the law is harmful.) and today more than ever before the phrase holds its ground. The law protects the mindful, and you will be able to make responsible personal and business decisions only with relevant legal knowledge and a well-skilled »legal assistant« - attorney, respectively.
